Instructions For Completing The Affidavit Of Eligibility For Deferred Disposition For The Offense Of Failure To Maintain Financial Responsibility



1.      You are NOT eligible to request deferred disposition by mail for your FAILURE TO MAINTAIN FINANCIAL RESPONSIBILITY violation if (If your case falls into one of the categories listed below, you may contact the court to set your case on a docket to talk to the prosecutor.):

  • You are under the age of 17 at the time of the violation;
  • You are age 17 and under the age of 25 at the time of your violation;or
  • You are charged with multiple violations on your citation (Exception: If the other violations are compliance violations such as expired registration, expired inspection or defective equipment violations.).

2.      You are NOT eligible to request deferred disposition by mail for your FAILURE TO MAINTAIN FINANCIAL RESPONSIBILITY violation if (If your case falls into one of the categories listed below, you may contact the court to set your case on a docket to talk to the prosecutor.):

  • At the time of the request, you are on deferred disposition for the same violation in any municipal or justice of the peace court.
  • At the time of the request, you have completed a deferred disposition for the same within the past 12 months preceding the date of the current offense.

3.      The court will grant deferred disposition for days from the date the judge grants the deferred disposition if you:

  • Meet the eligibility requirements;
  • Enter a plea of guilty or no contest and waive your right to a jury trial and your right to discovery;
  • Swear before a notary public to the truth of the information you are submitting on the enclosed form and sign the Affidavit in front of the notary public;
  • Sign the Order of Deferred Disposition (Sign where it says Defendant’s Signature; your signature means that you are agreeing to the terms of the deferred disposition.);
  • Mail the completed Affidavit of Eligibility and Order of Deferred Disposition form to the court no later than 3 days after the appearance date on your citation. The completed form CANNOT BE FAXED. THE COURT MUST HAVE THE ORIGINAL FORM WITH YOUR SIGNATURE. If the court does not receive the required form within 10 days of the date of your appearance date, warrants will be issued for your arrest.
  • Pay the court costs and fees with the submission of the forms. DO NOT PAY ON-LINE. Paying on-line with cause a conviction to be entered on your case. You must submit a check or money order with the form. See chart  below for the amount of deferred fee and costs.

You Will Be Required To Maintain And Show Proof Of Valid Insurance During The 180 Days Probation.

 

If you wish to plead not guilty and want a trial, do not use this form. You must put that request in writing and submit it to the court by mail or by fax on or before your appearance date.

Speeding (ONLY)

1.      You are NOT eligible to request deferred disposition for your SPEEDING violation if:

  • You hold a commercial driver’s license (CDL) or held a CDL on the date and at the time of the speeding violation
  • Your speeding violation occurred in a construction maintenance work zone when workers were present and the citation states on its face that the workers were present when the offense was;

2.      You are NOT eligible to request deferred disposition by mail for your SPEEDING violation if (If your case falls into one of the categories listed below, you may contact the court to set your case on a docket to talk to the prosecutor.):

  • You are under the age of 17 at the time of the violation;
  • You are age 17 and under the age of 25 at the time of your violation;
  • You are charged with speeding 25 mph or more over the speed limit;
  • You are charged with speeding 95 mph or more; or
  • You are charged with multiple violations on your citation (Exception: If the other violations are compliance violations such as expired registration, expired inspection or defective equipment violations.).

3.      You are NOT eligible to request deferred disposition by mail for your SPEEDING violation if (If your case falls into one of the categories listed below, you may contact the court to set your case on a docket to talk to the prosecutor.):
