Roadway Impact Fees
The City of New Braunfels established the Roadway Impact Fee Ordinance in 2007. Impact Fees are authorized under Chapter 395 of the Texas Local Government Code and are defined as a charge imposed against new development to pay for the off-site construction or expansion of infrastructure facilities that are necessitated by and benefit the new development.
Current Roadway Impact Fees
City Council adopted the current Roadway Impact Fee Ordinance on November 11, 2013. The ordinance includes land use assumptions, capital improvements plan, maximum fees, and collected fees.
The current collected fee structure is based on the subdivision platting date. Property platted prior to January 1, 2014, is subject to the 2007 Fee Schedule. Property platted on or after January 1, 2014, is subject to the 2013 Fee Schedule. Collected fees are assessed at the subdivision plat and assessed at building permits.

Roadway Impact Fee Offset Policy
City Council adopted the Policies and Procedures for Obtaining and Applying for Offsets and Credits Against Roadway Impact Fees on August 13, 2018. The resolution, policies and procedures, and associated applications are provided below.

Roadway Impact Fee Update
Chapter 395 of the Texas Local Government Code mandates that impact fees be reviewed and updated at least every five years. The City of New Braunfels last performed a review and update in 2013. Accordingly, staff initiated the current update in 2018 with anticipation of adoption in early 2020.
